1876 July – adjudicated a bankrupt in Britain SINGULAR ACTION. At the Croydon County Court yesterday, before Mr. H. J. Stoner, judge, an application in bankruptcy in the case Defries v. Myers was made, with the object of adjudicating Mr. J. W. Myers, the proprietor of the circus at the Crystal Palace, a bankrupt upon a petition presented against him by Messrs. Defries and Sons, of Houndsditch, who are creditors for the sum of £4520, alleging, as the act of bankruptcy, a fraudulent assignment of the debtor’s property in England. —Mr. Gates, Q.C., and Mr. Brough appeared for the petitioners, Messrs. Defries; Mr. De Gex Q.C. and Mr. Clay for the debtor • and Mr. Meadows White watched the case on behalf of the Crystal Palace Company. It appeared from the opening statement of Mr. Gates that Mr. Myers, in June, 1875, being about to open a large hippodrome in Paris, went to Messrs. Deb ies and Sons and asked them to do the decorations and gas engineering for him. This Messrs. Defries agreed to do and the contracts were entered into for 10,0001.. The work was done, and the establishment was opened on the 18th December in last year. After the work had been executed Mr. Myers paid Messrs. Defries 5000/. on account, but refused to pay the balance of their demand, and placed the matter before a French court, which subsequently gave judgment in favour of Messrs. Defries. Mr. Myers entered into a contract with the Crystal Palace company to open his circus on the 26th of last month, and on his landing with all his extensive establishment on the 21st ult. he executed a bill of sale in favour of Danvilliers for the sum of £5OOO. This was the act of bankruptcy upon which the petition was filed—After hearing witnesses and the speeches of counsel engaged on both sides, the learned judge decided that the assignment amounted to an act of bankruptcy. As regards the petitioner’s claim, that must be adjourned until the 21st proximo. In the meantime the receiver, Mr. N. C. Foreman, must remain in possession until the debtor gave security for the bill of £6,000 for the amount of the petitioner’s claim and costs. Sydenham Times – Tuesday 18 July 1876
